A.        RECOGNITION/PROCLAMATION/PRESENTATION:

 

1.       Proclaim the week of January 9 – 16 as Dr. Martin Luther King, Jr. Week.

 

 

B.        CONSENT AGENDA:

 

NOTE:  All matters listed below on the Consent Agenda are considered under one motion and will be enacted by one motion.  There will be no separate discussion on those items.  If discussion is desired, that item will be removed from the Consent Agenda and will be considered separately.

 

1.       Approve all claims.  The list of approved claims will be posted to the agenda the day after the City Commission meeting.

 

2.       Approve licenses as recommended by the City Clerk’s Office.    

 

3.       Approve appointments as recommended by the Mayor. 

 

4.       Bid and purchase items:

 

a)       Set a bid opening date of January 24, 2012, for hourly rate for individual contractual repairs, maintenance services and tree trimming (emergency/non emergency).   Staff Memo

 

b)       Authorize renewal of the ESRI Enterprise License Agreement (for GIS software) for the period of January 22, 2012 – January 21, 2013, in the amount of $50,000.   Staff Memo

 

c)       Authorize the City Manager to execute a contract renewal with Marsh McBirney – Hach, for the period of January 2012 through December 2012, for data delivery services associated with the wastewater collection system’s long-term flow and rainfall monitoring program, for $52,800.   Staff Memo & Attachments

 

5.       Adopt on second and final reading, Ordinance No. 8690/County Resolution No. ____, for Text Amendments (TA-3-3-10) to the joint city/county subdivision regulations in the City of Lawrence Land Development Code, Chapter 20, Article 8 and the Douglas County Code, Chapter 11, Article 1 to revise process requirements for division of property through Certificates of Survey, Minor Subdivisions and Major Subdivisions. 6.       Authorize the Mayor to execute a Lease and License Agreement and a Lease Agreement with Community Wireless Communications (CWC) granting access to certain City owned facilities, rights of way and a portion of fiber optics installed within the City in exchange for a $30,000 contribution from CWC to the fiber project and a 5% fee on gross revenues.   Staff Memo & Attachments

 

7.       Authorize staff to negotiate a fiber sharing agreement between the City of Lawrence and Douglas County, for future City Commission consideration.  Staff Memo

1.       Consider the following items related to occupancy limits:

 

a)       Consider approving Text Amendment, TA-10-15-11, to the City of Lawrence Land Development Code, multiple articles, defining occupancy and clarifying the applicability of occupancy limits in non-RS districts and consider adopting on first reading, Ordinance No. 8689, approving Text Amendments (TA-10-15-11) to the City of Lawrence Land Development Code, multiple articles, defining occupancy and clarifying the applicability of occupancy limits in non-RS districts. ACTION:      Approve Text Amendments (TA-10-15-11) and adopt on first reading, Ordinance No. 8689, approving Text Amendments (TA-10-15-11) to the City of Lawrence Land Development Code, multiple articles, defining occupancy and clarifying the applicability of occupancy limits in non-RS districts, if appropriate.

 

b)       Consider adopting on first reading, Ordinance No. 8692, which, if enacted, would replace Chapter 6, Article 13 of the City Code, regulating the rental of dwellings in RS Zoning Districts.   Staff Memo  

 

ACTION:      Adopt on first reading Ordinance No. 8692, which, if enacted, would replace Chapter 6, Article 13 of the City Code, regulating the rental of dwellings in RS Zoning Districts, if appropriate.

 

 

2.       Consider approving text amendments, TA-8-12-11, to various sections of the City of Lawrence Land Development Code, Chapter 20, regarding revisions to the district criteria and development standards for development adjacent to R (Residential) Districts, clarify other density and dimensional standards, Section 20-1701 to clarify or add terms used in the density and dimensional standards table, and Sections 20-211 and 20-212 to make consistent with potential changes in Article 6, and adopt on first reading, Ordinance No. 8682, approving text amendments, TA-8-12-11, to various sections of the City of Lawrence Land Development Code, Chapter 20, regarding revisions to the district criteria and development standards for development adjacent to R (Residential) Districts, clarify other density and dimensional standards, Section 20-1701 to clarify or add terms used in the density and dimensional standards table, and Sections 20-211 and 20-212 to make consistent with potential changes in Article 6.   (PC Item 2; approved 8-0 on 10/24/11)   Staff Report   Incorporation by Reference   PC Minutes   Correspondence - Updated 01/06/12

3.       Consider motion to recess into executive session for approximately 45 minutes for the purpose of consultation with attorneys for the city which would be deemed privileged in the attorney-client relationship.  The justification for the executive session is to keep attorney-client matters confidential.  The regular meeting of the City Commission will resume in the commission meeting room at the conclusion of the executive session.  

 

ACTION:      Approve motion to recess into executive session, if appropriate.

Board of Zoning Appeals/Sign Code Board of Appeals:

One vacancy for a position that expires 09/30/13. 

 

Community Development Advisory Committee:

One position expires 09/30/11.  This is an at-large position.

 

Convention and Visitors Bureau Advisory Board:

Two vacancies – one position expires 07/01/14 and one position expires 07/01/15 and is designated for a hotel/motel industry representative.

 

Downtown Task Force:

Appointment of seven to eleven members available on this newly formed task force.

 

Electrical Code Board of Appeals:

One vacancy for a position that expired 03/31/11.  Eligibility requirements exist for this board.

 

Fire Code Board of Appeals:

Two positions expire 01/31/12.  Both are eligible for reappointment to additional terms.

 

Human Relations Commission:

One vacancy for a position that expires 09/30/14.

 

Lawrence Alliance:

Two vacancies, one that expired 11/30/11 and one that expires 11/30/12.

 

Lawrence Citizen Advisory Board:

One vacancy for a position that expires 03/01/12.

 

Lawrence Cultural Arts Commission:
