RE:	Vacation of Right-of-way 1209 E. 23^rd Street

On December 11, 2012, the City Commission will hold a public hearing to consider the vacation of right-of-way located in Commerce Park East Addition (commonly known as 1209 E. 23^rd Street; Automotive Analysts, Inc.).  The owners, William & Sharon Ray, are requesting that the right-of-way be vacated so they can have unrestricted use of the area for parking and merchandise display.  There have been a number of properties along 23^rd Street that have built new buildings close enough to 23^rd Street that would prohibit the possibility of a frontage road ever being built. 

All utilities, as well as property owners within 200 feet, were notified.  The Governing Body will reserve a 15 foot utility easement along the east side of the proposed vacated area to address utility company concerns..

Action Requested:     Hold public hearing and, pending discussion, approve order of vacation.
