Initiate Rezoning for 2200 and 2206 E. 23rd Street from UR and RS10 to CS.

Initiate rezoning of 2200 E. 23rd Street and 2206 E. 23rd Street from UR (Urban Reserve) District and RS10 (Single-Dwelling Residential) District to CS (Commercial Strip) District. 

 

Rezoning will require a public hearing before the Lawrence-Douglas County Planning Commission before a recommendation is submitted to the Lawrence City Commission for a final decision.

 

Background

Staff recently reviewed zoning and annexation records for the property at 2200 E. 23rd Street.  The review indicates the zoning of the property does not match the existing use, a condition apparently created upon annexation.  The property at 2206 E 23rd Street is east of 2200 E 23rd Street and is zoned for residential uses in an area that is otherwise zoned for non-residential uses.

 

2200 E. 23rd Street is zoned UR (Urban Reserve) District and has a commercial use.  The UR District is a holding district for properties annexed into Lawrence and does not permit the expansion of commercial uses on the property.  2206 E. 23rd Street is zoned RS10 (Single-Dwelling Residential) District and the current use is a fraternal organization, which is permitted by Special Use Permit.  The RS10 District does not permit commercial uses.

 

The properties to the west of the subject properties are zoned CS (Commercial Strip) District.  The CS District is also appropriate for the subject properties going forward.  Both property owners have been contacted and have agreed to this rezoning initiation.
