Lot 3A of Alvamar Northwest No. 3 at 1520-1540 Wakarusa Drive (SP-04-20-08) Ordinance Variance Request from City Code 19-214(A) 

 

Please include the following item on the City Commission consent agenda for consideration at the May 20, 2008 meeting:

Approval of the request by Steve Block, manager of Wakarusa 15 Associates LLC (the property owner of Lot 3A of Alvamar Northwest No. 3), for a variance from City Code 19-214 A which states, "each lot shall have direct access to the City sanitary sewer main in City public right of way or City public utility easement.  Such access shall not cross property ownership lines unless the access is in adjacent City public right of way or adjacent City public utility easement.” 

The site plan for a development at 4811 Bob Billings Parkway was recently submitted to the City for review.  During the review, it was noted that the existing private sanitary sewer service line for 1520-1540 Wakarusa Drive crosses the property at 4811 Bob Billings Parkway to connect to the nearest public sanitary sewer main.  Provided that the City Commission grants the variance request, the private service line for 1520-1540 Wakarusa Drive will remain across 4811 Bob Billings Parkway but be relocated so that it is not under proposed structures on 4811 Bob Billings Parkway. A private sanitary sewer easement will be granted by the property owner of 4811 Bob Billings Parkway. 

The property owner of 1520-1540 Wakarusa Drive has been notified that Lot 3A will be required to meet City Code 19-214(A) for future site plan submittals that include significant improvements.  Compliance with City Code 19-214(A) will require sanitary sewer main extension to the property.   

The Department of Utilities has reviewed the request and recommends that the variance be approved.

Action Request.  Approve the request for a variance from City Code 19-214  A which states, “each lot shall have direct access to the City sanitary sewer main in City public right of way or City public utility easement.  Such access shall not cross property ownership lines unless the access is in adjacent City public right of way or adjacent City public utility easement,” for Lot 3A of Alvamar Northwest No. 3 (1520-1540 Wakarusa Drive).
