A.        RECOGNITION/PROCLAMATION/PRESENTATION:

 

1.       Proclaim the week of May 3 – 9, 2009 as National Music Week in Lawrence.

 

2.       Proclaim Saturday, May 9, 2009 as Sertoma Bar-B-Q Cook-Off Day.

 

3.       Proclaim the month of May 2009 as Mental Health Month.

 

4.       Proclaim the month of May 2009 as Tennis Month.

 

5.       Recognition of Lawrence Cultural Arts Commission 2009 Grant Award Recipients.

 

 

 

B.        CONSENT AGENDA:

 

NOTE:  All matters listed below on the Consent Agenda are considered under one motion and will be enacted by one motion.  There will be no separate discussion on those items.  If discussion is desired, that item will be removed from the Consent Agenda and will be considered separately.

 

1.       Approve City Commission meeting minutes from 04/14/09.

 

2.       Receive minutes from various boards and commissions:

 

          Sustainability Advisory Board meeting of 02/11/09

Contractor Licensing Board meeting of 2/25/09

Planning Commission meetings of 03/23/09 & 03/25/09

 

3.       Approve all claims.  The list of approved claims will be posted to the agenda the day after the City Commission meeting.

 

4.       Approve licenses as recommended by the Department of Administrative Services.    

 

5.       Bid and purchase items:

 

a)       Waive bidding requirements and approve sole source purchase of one set (power unit, spreader, cutter, short ram, long ram, and two hoses) of Genesis hydraulic rescue tools from RAW Enterprises for the Fire/Medical Department, for $29,650.   Staff Memo & Attachments

 

b)       Waive bidding requirements and approve sole source purchase of water meters for the Utilities Department from Midwest Meter for $166,440 for the implementation of the 2009 Meter Replacement Program.   Staff Memo & Attachments

         

6.       Adopt the following ordinance(s) on first reading:

 

a)       Ordinance No. 8390, allowing the possession and consumption of alcoholic beverages at Burcham Park on May 23, 2009 related to the Patten-Hill family wedding rehearsal dinner.   Staff Memo & Attachments

 

b)       Ordinance No. 8392, authorizing the sale, possession, and consumption of alcoholic beverages at Broken Arrow Park on May 8-9, 2009 for the Lawrence Sertoma BBQ Cook-off and fundraiser.   Staff Memo & Attachments

 

c)        Ordinance No. 8389 authorizing the City’s use of eminent domain authority and condemning the required property interests for the Burroughs Creek Trail.  Staff Memo & Attachments

 

 

7.       Adopt on second and final reading, Ordinance No. 8388, amending (TA-04-03-08) and enacting sections of Chapter 20 of the Lawrence City Code (Land Development Code) pertaining to certain Community Facilities (Temporary Shelters and Social Service Agencies).

9.       Authorize the Mayor to sign a Subordination Agreement for Donna Williams and Jean Dixon, 1601 Kenwood.   Staff Memo

 

10.     Receive staff memo and approve the formation of a Douglas County- Lawrence Complete Count Committee to assist in publicity for the 2010 Census.   Staff Memo

 

11.     Approve agreement with Lawrence Freenet to install wireless devices on City light poles in the downtown area.   Staff Memo & Attachments

ADDRESSING THE COMMISSION:          The public is allowed to speak to any regular agenda item or give public comment after first being recognized by the Mayor.  Individuals are asked to come to the microphone, sign in, and state their name and address.  Speakers should address all comments/questions to the Commission.

 

D.                REGULAR AGENDA ITEMS:          

 

1.       Consider deferring the second and final reading of Ordinance No. 8387, for the Rezoning (Z-2-2-09) of 1725 New Hampshire Street from RM24 (Multi-Dwelling Residential) to CS (Commercial Strip), until such time as the contract purchaser commits to close on the purchase of the property, or September 15, 2009, whichever is sooner.  Deferral Request

 

ACTION:      Defer the second and final reading of Ordinance 8387 per applicant request, if appropriate.

 

 

2.       Receive 2008 Health Department Annual Report. Presentation – Added 04/27/09

4.       Conduct public hearing to discuss the condition of the dilapidated structure at 1207 E. 13th Street and to consider declaring the structure unsafe and dangerous and ordering its repair or removal within a specified period of time.   Staff Memo & Attachments   Correspondence - Added 04/28/09

 

ACTION:      Conduct public hearing and adopt Resolution No. 6834, declaring the structure unsafe and dangerous and order its repair or removal, if appropriate.

 

 

5.       Consider the following items related to the American Recovery and Reinvestment Act:

 

a)       Consider approving sole source purchase of at least 44 handheld and 33 mobile digital radios utilizing the Edward Byrne Memorial Justice Assistance Grant for the Police Department, for $278,376.12.   Staff Memo

6.       Receive recommendations from the Fuels Task Force (FTF) regarding incorporating alternative fuels into the City’s transit fleet and authorize staff to proceed with the purchase of transit vehicles pursuant to those recommendations.   Staff Memo & Attachments

1.       Establish possible date for City Commission study session with the Community Commission on Homelessness (CCH) to discuss an interim/temporary emergency shelter after May 1, 2009.  Due to the Salvation Army closing its emergency shelter effective May 1, 2009, the CCH is requesting the study session be held before May 1, 2009.

 

2.        Consider request to have a joint meeting with Douglas County Commission and other Douglas County/City representatives.

I.         CURRENT VACANCIES – BOARDS/COMMISSIONS:

 

Listed below are existing and upcoming vacancies on City of Lawrence Boards and Commissions.  If interested in serving on a board, citizens should visit the website at http://www.lawrenceks.org/boards.shtml to volunteer online, or send a letter of interest to the Mayor, P.O. Box 708, Lawrence, KS 66044.

 

Aviation Advisory Board:

Four positions, held by Sneegas, Fish, Klinkenberg, and Atwood, expire 05/31/09.  All are eligible for reappointments to additional terms.  One position, held by Bryant, expires 05/31/11.  Mr. Bryant has indicated that he will be resigning his term effective 05/31/09.

 

Community Development Advisory Committee:

(Formerly known as Neighborhood Resources Advisory Committee:

Two vacancies for the un-expired positions held by Roussel and Mangan expire 09/30/10.  All positions are at-large positions.   

 

Jayhawk Area Agency on Aging:

One vacancy (Board of Directors) for an unexpired position (Johnson) which expires 09/30/09.  Two vacancies, one for Advisory Council and one for Board of Directors, for positions that expired 09/30/08. 

 

Lawrence-Douglas County Metropolitan Planning Commission:

Two positions, held by Findeldei and Carter, expire 05/31/09.  Both are eligible for reappointment to an additional term.

 

Mechanical Code Board of Appeals:

One vacancy that expired 03/31/09. 

 

Traffic Safety Commission:

One position, held by Ziegelmeyer, expires 04/30/09.  Mr. Ziegelmeyer has served two consecutive terms and is not eligible for reappointment to an additional term.
